Terms of service

Everything in SideBet is fantasy cash and bragging rights. No real-money betting, deposits, withdrawals, or cash-outs. If someone asks you to send real money over a SideBet result, that's not us — don't do it.

Pools are private social games. Don't harass people, don't post illegal stuff, and don't try to break the product. Admins can boot members; we can suspend accounts that trash the place.

You own the questions and chatty copy you post, but you give us permission to host and show it so the Service works. Don't post anything you don't have rights to share.

Hidden markets stay out of a subject's view until settlement. After that, the reveal can show what happened and who bet. Don't use SideBet to stalk, scam, or hurt people.

Features may change, break, or disappear. We'll update these terms when the legal bits change. Keep using SideBet after an update means you accept the new terms.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms. You represent that the information you provide is accurate and that you will keep it up to date.

SideBet provides private prediction pools and related social features that use play money and other fantasy balances (including SideCoin). The Service is for entertainment among invited or otherwise authorized participants. SideBet is not a casino, bookmaker, broker, financial institution, or real-money gambling service. Play money and SideCoin have no cash value, are not redeemable for real currency or prizes of monetary value from SideBet, and may not be transferred outside the Service except as expressly allowed by features we provide.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at legal@sidebet.club if you suspect unauthorized access. We may refuse registration, reclaim usernames, or require additional verification where reasonably necessary to protect the Service or other users.

You agree not to: • Use the Service for real-money wagering, payment collection, money transmission, or any unlawful gambling activity; • Harass, threaten, defame, dox, exploit, or otherwise harm other people; • Post content that is illegal, infringing, fraudulent, or that violates another person's rights; • Attempt to gain unauthorized access to the Service, other accounts, or related systems; • Interfere with or disrupt the Service, including by introducing malware or overloading infrastructure; • Scrape, reverse engineer, or automate access to the Service except as allowed by applicable law or our express written permission; • Misrepresent your identity or affiliation in a way that deceives others; • Use the Service in any manner that violates applicable law or these Terms.

You retain ownership of content you submit to the Service ("User Content"), including pool names, market questions, and similar materials. You grant SideBet a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and otherwise use User Content as needed to operate, improve, promote, and secure the Service. You represent that you have all rights necessary to submit User Content and to grant this license. We may remove User Content that violates these Terms or that we reasonably believe creates risk for users or the Service.

Pool membership, roles, trades, positions, and leaderboards may be visible to other members of a pool. Certain markets may use "lowkey" or similar features that temporarily limit visibility to a tagged subject; upon settlement or reveal, related information may become visible to that subject and other authorized participants. You are solely responsible for the social consequences of content and activity you create or join.

The Service, including its software, design, trademarks, and documentation, is owned by SideBet or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. You may not copy, modify, or create derivative works of the Service except as permitted by law.

The Service may integrate with third-party services (for example, Google authentication, analytics, hosting, email delivery, and error monitoring). Your use of those services may be subject to their own terms and privacy policies. SideBet is not responsible for third-party services we do not control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDEBET DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT MARKET OUTCOMES, LEADERBOARDS, OR PLAY-MONEY BALANCES WILL MEET YOUR EXPECTATIONS. SIDEBET DOES NOT PROVIDE FINANCIAL, LEGAL, OR GAMBLING ADVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDEBET AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You will defend, indemnify, and hold harmless SideBet and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate your access immediately if you violate these Terms, if we reasonably believe your use creates risk or legal exposure, or if we discontinue the Service. Upon termination, your right to use the Service ends, and provisions that by their nature should survive will survive, including ownership, disclaimers, limitations of liability, and indemnification.

We may modify or discontinue all or part of the Service at any time. We may also update these Terms by posting a revised version with an updated effective date. Except where required otherwise by law, continued use of the Service after the revised Terms take effect constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.

These Terms are governed by the laws of the State of California, excluding its conflict-of-laws rules, unless mandatory consumer protections in your place of residence provide otherwise. Except where prohibited, you and SideBet agree that courts located in San Francisco County, California will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, subject to any non-waivable rights you may have under applicable law.

These Terms, together with the Privacy Policy and any feature-specific terms we present in-product, are the entire agreement between you and SideBet regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
